จำเลยเคยยอมให้ประชาชนใช้ยวดยานพาหนะผ่านที่ดินของจำเลยออกถนนหลวงมาเป็นเวลา ๑๕ ปี แล้วดังนี้ จำเลยจะมาเปลี่ยนแปลงทางนั้นให้เป็นทางเดินสำหรับคนเดินอย่างเดียวไม่ได้ ต้องทำทางให้ยานพาหนะเดินได้ด้วย
