ผู้ตายมาอาศัยแลฝากผีฝากไข้ไว้กับโจทย์ ครั้นผู้ตาย ๆ ลง โจทย์ได้ทำศพสิ้นเงินไป ๒๘๐ บาท โจทย์จึงฟ้องขอให้จำเลยผู้รับมรฎกผู้ตายใช้เงินรายนี้ ศาลฎีกาตัดสินว่าจำเลยผู้รับมรฎกต้องเอาทรัพย์มรฎกออกสินใช้ค่าทำศพนั้นให้แก่โจทย์
