เมื่อได้ความว่าจำเลยท้าเขาก่อน แล้วเขาจึงท้าตอบ แล้วจำเลยไล่ฟันเขาตายเช่นนี้ จะเรียกว่าเขายั่วโทษะไม่ได้ ๓ คนใช้มีดแลไม้ตีแลแทงเขา เขาทนบาดเจ็บอยู่ได้ ๖ วันจึงตายวินิจฉัยว่ามีความผิดฆ่าคนตายโดยไม่เจตนา(เนียล-)
