ได้ความว่าจำเลยใช้ปืนยิง น.กำนันกับลูกบ้านซึ่งไปตรวจจับผู้ร้าย แต่ในเวลานั้นจำเลยไม่ทราบว่าว่าเป็นเจ้าพนักงานดังนี้ ศาลเดิมตัดสินยกฟ้อง โดยสงสัยพะยานโจทก์ ศาลฎีกาตัดสินยื่นตามศาลอุทธรณ์ว่าจำเลยมีผิดฐานพยายามฆ่าคนตาม ม.๒๔๙-๖๐ ให้จำคุก ๑๐ ปี
