หมวด ๘ บทกำหนดโทษ

ผู้ใดปลอมแปลง หรือใช้เครื่องหมายเลียนแบบ หรือกระทำการใด ๆ เพื่อให้บุคคลอื่นหลงเข้าใจผิดว่า พันธุ์พืชนั้นเป็นพันธุ์พืชที่ได้รับความคุ้มครองตามพระราชบัญญัตินี้ ต้องระวางโทษจำคุกตั้งแต่หกเดือนถึงห้าปี และปรับตั้งแต่สองหมื่นถึงสองแสนบาท
