ส่วนที่ ๓ ผลของการจำนองและการบังคับจำนอง

ถ้าเอาเรือที่จำนองออกขายหรือขายทอดตลาดแล้วได้เงินจำนวนสุทธิน้อยกว่าจำนวนเงินที่ค้างชำระแก่ผู้รับจำนอง หรือถ้าเอาเรือจำนองหลุดและเรือนั้นมีราคาน้อยกว่าจำนวนเงินที่ค้างชำระแก่ผู้รับจำนอง เงินยังขาดจำนวนอยู่เท่าใดให้ถือเป็นหนี้สามัญซึ่งผู้รับจำนองอาจเรียกร้องจากลูกหนี้ได้ แต่ถ้าผู้จำนองไม่ได้เป็นลูกหนี้จะเรียกร้องจากผู้จำนองไม่ได้
