กรณีความผิดตามมาตรา ๒๙๖ หรือมาตรา ๒๙๖/๑ ในส่วนที่เกี่ยวกับการกำหนดโทษปรับถ้าผู้กระทำความผิดได้รับหรือพึงได้รับผลประโยชน์จากการกระทำความผิดนั้นให้ปรับเป็นเงินไม่เกินสองเท่าของผลประโยชน์ ทั้งนี้ ค่าปรับดังกล่าวต้องไม่ต่ำกว่าค่าปรับขั้นต่ำที่บัญญัติไว้ในมาตรา๒๙๖ หรือมาตรา ๒๙๖/๑ แล้วแต่กรณี
