ความผิดตามที่บัญญัติไว้ในพระราชบัญญัตินี้ให้ชำระที่ศาลอาญาแต่ถ้าการสอบสวนได้กระทำในท้องที่ที่อยู่ในเขตอำนาจของศาลใด ให้ชำระที่ศาลนั้นได้ด้วย ถ้าเป็นคดีที่อยู่ในเขตอำนาจศาลทหารตามกฎหมายว่าด้วยธรรมนูญศาลทหารให้ชำระที่ศาลทหารกรุงเทพ แต่ถ้าการสอบสวนได้กระทำในท้องที่ที่อยู่ในเขตอำนาจของศาลทหารใด ให้ชำระที่ศาลทหารนั้นได้ด้วย
