ในกรณีที่พระราชบัญญัตินี้บัญญัติว่า การกระทำใดของผู้รับจำนำเป็นความผิด ถ้ากรรมการ ผู้จัดการ หรือพนักงานของผู้รับจำนำเป็นผู้กระทำหรือร่วมกระทำด้วย ผู้นั้นต้องระวางโทษเช่นเดียวกับที่บัญญัติไว้สำหรับผู้รับจำนำ
