เมื่อการสมรสสิ้นสุดลงด้วยการหย่าหรือศาลพิพากษาให้เพิกถอนการสมรส ให้ฝ่ายซึ่งใช้ชื่อสกุลของอีกฝ่ายหนึ่งกลับไปใช้ชื่อสกุลเดิมของตน เมื่อการสมรสสิ้นสุดลงด้วยความตาย ให้ฝ่ายซึ่งยังมีชีวิตอยู่และใช้ชื่อสกุลของอีกฝ่ายหนึ่งมีสิทธิใช้ชื่อสกุลนั้นได้ต่อไป แต่เมื่อจะสมรสใหม่ ให้กลับไปใช้ชื่อสกุลเดิมของตน
