ห้ามมิให้อุทธรณ์หรือฎีกาในปัญหาข้อกฎหมายที่มิได้ยกขึ้นมาว่ากันตั้งแต่ศาลทหารชั้นต้น เว้นแต่จะเป็นข้อกฎหมายที่เกี่ยวกับความสงบเรียบร้อยหรือเกี่ยวกับการไม่ปฏิบัติตามบทบัญญัติอันว่าด้วยการอุทธรณ์และฎีกา
