ภาค ๓ หนี้

หนี้ซึ่งเกิดจากการละเมิด ให้บังคับตามกฎหมายแห่งถิ่นที่ข้อเท็จจริงซึ่งทำให้เป็นการละเมิดนั้นได้เกิดขึ้น ความในวรรคก่อนไม่ใช้แก่บรรดาข้อเท็จจริงที่เกิดขึ้นในต่างประเทศ ซึ่งไม่เป็นการละเมิดตามกฎหมายไทย กรณีจะเป็นอย่างไรก็ตาม ฝ่ายที่ต้องเสียหายจะเรียกร้องค่าสินไหมทดแทน หรือทางแก้อย่างใดไม่ได้นอกจากที่กฎหมายไทยยอมให้เรียกร้องได้
