Section 5 พระราชบัญญัติยศทหาร พุทธศักราช 2479

ผู้ใดจะเป็นทหารสัญญาบัตรยศชั้นใดได้นั้น จะได้ทรงพระกรุณาโปรดเกล้าฯ แต่งตั้งขึ้น เว้นแต่ผู้ที่มียศเป็นทหารสัญญาบัตรอยู่แล้วรับราชการประจำในสังกัดใหม่กองทัพใด ทหารยศไม่ตรงกับสังกัดกองทัพนั้น ก็ให้มียศตามกองทัพที่สังกัดใหม่ในชั้นเดียวกับยศเดิมได้ ตั้งแต่วันที่มีคำสั่งให้รับราชการประจำในสังกัดใหม่
