ถ้าความปรากฏแก่พนักงานสอบสวนว่าคู่กรณีที่เป็นผู้ต้องหาจงใจไม่ปฏิบัติตามข้อตกลงโดยไม่มีเหตุอันควร ให้พนักงานสอบสวนผู้มีอำนาจออกคำสั่งมีคำสั่งดำเนินคดีต่อไป
