การประเมินราคาของเพื่อกำหนดค่าปรับตามพระราชบัญญัตินี้ ให้ถือตามราคาแห่งของชนิดเดียวกันซึ่งได้เสียอากรครบถ้วนแล้วตามที่ซื้อขายในเวลาหรือใกล้เวลาที่กระทำความผิดนั้น เว้นแต่ไม่มีราคาดังกล่าวให้ถือตามราคาที่อธิบดีกำหนด
