สิทธิการรับเงินจากกองทุนสงเคราะห์ตามพระราชบัญญัตินี้เป็นสิทธิเฉพาะตัวไม่อาจโอนแก่กันได้ และไม่อยู่ในข่ายแห่งการบังคับคดี เว้นแต่เป็นการชำระหนี้ที่ผู้อำนวยการ ครู และบุคลากรทางการศึกษาเป็นหนี้กองทุนสงเคราะห์ตามพระราชบัญญัตินี้
