ในกรณีที่โจทก์มิได้ให้การแก้ฟ้องแย้งของจำเลยภายในระยะเวลาที่กำหนดไว้ ให้นำบทบัญญัติในส่วนที่ ๑ นี้มาใช้บังคับเพียงเท่าที่เกี่ยวกับฟ้องแย้งเช่นว่านั้นโดยอนุโลม
